Terms of Use
Last updated: [PUBLICATION DATE]
These terms are the agreement between you and Picameo when you download or use the app. They are written to be read, not to be skimmed past — the short version is that the app is licensed to you for personal use, what you make with it stays yours, and the app is provided as it is.
This document describes Picameo as it is built today. Anything marked in a highlighted box like THIS is a placeholder that still needs a real value, and this is a plain-language draft rather than reviewed legal advice — have a lawyer look at it before you publish.
1. Acceptance of these terms
By downloading, installing or using Picameo, you agree to these Terms of Use. If you do not agree with them, do not use the app. Picameo is provided by [LEGAL ENTITY NAME] (“Picameo”, “we”, “us”).
2. Eligibility
You must be at least [MINIMUM AGE] years old to use Picameo, and old enough to enter into a binding agreement where you live. If you use the app under a parent’s or guardian’s App Store account, they are responsible for your use of it and for any purchases made.
3. Your licence to use the app
We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to install and use Picameo on Apple devices that you own or control, for your own non-commercial use, in line with the App Store’s Usage Rules. This is a licence, not a sale: we keep ownership of the app itself.
4. Content you create
The photos you bring to Picameo and the cameos, pages and collections you make from them are yours. We claim no ownership of them, and because they stay on your device we do not receive a copy, use them to promote Picameo, or use them to train anything.
You are responsible for what you put into the app: for having the right to use the photos you import, and for respecting the privacy and rights of anyone who appears in them. You are also responsible for keeping your own backups — see section 10.
5. Our intellectual property
Picameo’s name, logo, cameo frame artwork, designs, textures, animations, interface, source code and written material belong to us and are protected by copyright and other laws. Using the app does not give you the right to copy, resell, redistribute or create derivative works from any of it, or to use the Picameo name or marks without our written permission. A cameo image you export for your own use is of course yours to keep and to share.
6. Purchases and subscriptions
Picameo offers paid access, which may be sold as a one-time lifetime purchase or as a recurring subscription. Prices, billing periods and what each option includes are shown in the app before you buy.
- All purchases are made through the App Store and charged to your Apple ID account.
- A subscription renews automatically at the end of each period unless you turn off auto-renewal at least 24 hours before it ends. Manage or cancel it in your Apple ID account settings — uninstalling the app does not cancel a subscription.
- A lifetime purchase is a one-time payment for continued access to the paid features of Picameo for as long as the app is offered and supported.
- Refunds are handled by Apple under its own policy. We cannot issue refunds for App Store purchases directly.
7. Apple's role
Picameo is distributed through the App Store, and these terms are between you and us, not between you and Apple. Apple is not responsible for the app or its content, and has no obligation to provide support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use of the app must also comply with the App Store Terms of Service and Usage Rules, and if anything here conflicts with them, those rules take precedence.
8. Acceptable use
You agree not to:
- use Picameo to create or store material that is unlawful, or that infringes someone else’s rights;
- use images of other people in a way that harasses them or violates their privacy;
- reverse engineer, decompile, tamper with or attempt to extract the source code or assets of the app, except where the law expressly allows it;
- circumvent purchase verification, or use the paid features without paying for them;
- redistribute the app, or use it to build a competing product.
9. Availability and changes to the app
We are actively developing Picameo. Features may be added, changed or removed, and we may release updates that you need to install to keep using the app. We may also suspend or discontinue the app, in whole or in part, at any time. We will try to give reasonable notice of a significant change, but we do not promise that any particular feature will remain available.
10. Disclaimers
Picameo is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or compatible with every device or iOS version.
Because your content is stored only on your device, we cannot recover it. Loss or damage to your device, deleting the app, or a failed device restore can permanently remove your cameos. Keep your own backups of photos that matter to you.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for any loss of data, content, profits or goodwill arising from your use of — or inability to use — Picameo. Where liability cannot be excluded, our total liability to you is limited to the amount you paid for the app in the twelve months before the claim arose. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
12. Termination
You can end this agreement at any time by deleting Picameo from your devices. We may suspend or end your licence if you materially breach these terms. Sections that by their nature should survive termination — ownership, disclaimers, limitation of liability — continue to apply afterwards.
13. Governing law
These terms are governed by the laws of [GOVERNING JURISDICTION], without regard to its conflict-of-law rules, and the courts of [VENUE] will have jurisdiction over any dispute, except where the law of your country of residence gives you the right to bring a claim locally.
14. Changes to these terms
We may update these terms as Picameo changes. When we do, we will revise the date at the top of this page. If a change is significant, we will make a reasonable effort to tell you in the app. Continuing to use Picameo after an update means you accept the revised terms.
15. Contact
Questions about these terms can be sent to [ADD-CONTACT-EMAIL].
